1. Who's who

"BookingCo" (BookingCo (Pty) Ltd, registered in South Africa) operates SafariBookNow as a booking-search website and provides the technology that lets you check live lodge availability and submit a booking request.

"ASG" (ASG Holdings (Pty) Ltd, 2021/010590/07, trading as African Safari Group) is the travel agency that accepts your booking, takes your payment, issues your invoice and voucher, and handles every aspect of customer service before, during and after your trip. ASG operates exclusively as agent and intermediary for the lodges ("Suppliers") that appear on this site.

By using SafariBookNow you agree to these Terms and to ASG's Terms and Conditions, which are incorporated by reference and govern your booking once placed.

2. What SafariBookNow is — and isn't

SafariBookNow is a booking-search website. We let you:

• Browse safari lodges across participating reserves;
• Search live availability for your dates and party composition;
• Submit a booking through the Reservaroo booking widget, which is operated by Reservaroo and processes the booking on behalf of ASG.

BookingCo is not the lodge, a tour operator, a travel agency, your travel agent, or a financial-services provider. BookingCo's role is limited to operating the SafariBookNow website and the booking-search functionality. Every customer-facing service after you submit a booking — payment processing, confirmation, invoicing, voucher issuing, pre-arrival communications, in-trip support, cancellations, refunds — is provided by ASG under ASG's own T&Cs.

3. ASG's terms apply to your booking

When you submit a booking through this site:

• A contract is formed between you and ASG (and, in respect of your stay, between you and the lodge as ASG's Supplier).
• ASG's Terms and Conditions govern that contract, including ASG's service-fee, payment, cancellation, refund, force-majeure, insurance, risk-acknowledgement, travel-documents, children, data-protection and disclaimer provisions. They are available at africansafarigroup.com/terms-and-conditions/ and are incorporated into these Terms by reference.
• The lodge's own terms also apply to your actual stay (cancellation policy, child policy, age restrictions, lodge rules), as set out in the booking widget before you pay.

You acknowledge that you have read, understood, and agree to be bound by ASG's Terms and Conditions and the lodge's terms. If anything in these BookingCo Terms is inconsistent with ASG's Terms or the lodge's terms in respect of the booking itself, ASG's Terms (and the lodge's terms) prevail.

4. Payments and refunds

Payment for your booking is processed by ASG through ASG's payment partners (which may include Peach Payments, PayPal, Flywire, or Turnstay as merchant of record for American Express transactions). BookingCo does not receive, hold, process, or store any payment.

ASG's payment, deposit and balance policy applies (typically 30% deposit within 48 hours of booking and balance no later than 60 days before travel — see ASG's Terms for full detail).

Cancellations and refunds are governed by ASG's cancellation policy and the lodge's own terms. All cancellation requests must be made in writing by email to ASG. BookingCo has no role in cancellation or refund decisions.

5. Travel insurance

You are required to obtain comprehensive travel insurance promptly after making your first payment, covering all aspects of your booking (including cancellation for any reason, medical evacuation, and force majeure). You and your fellow travellers indemnify ASG and BookingCo against any liability arising from your failure to obtain such insurance. See ASG's Terms, clause 8.

6. Risk acknowledgement

You acknowledge that safari activities — game drives, walking safaris, boating, light-aircraft transfers, off-road travel, remote-area accommodation, and interaction with wildlife — are inherently hazardous. You and every guest in your booking voluntarily assume all risks associated with such activities. Injury, illness or worse can occur even where reasonable care is taken. See ASG's Terms, clauses 12 and 13.

7. Liability — BookingCo

To the fullest extent permitted by law:

• BookingCo provides SafariBookNow "as is", without warranty as to availability, accuracy, completeness, or uninterrupted operation. Lodge content, photography, pricing and availability are sourced from ASG and the Suppliers and may change without notice.
• BookingCo is not liable for anything that happens after you submit a booking — including but not limited to lodge service quality, the conduct of any Supplier or its staff, payment failures, missed bookings, cancellations, refund disputes, illness, injury, death, loss of property, force-majeure events, transport delays, visa or passport problems, or the acts or omissions of ASG, the lodge, Reservaroo, Turnstay, Peach Payments, PayPal, Flywire, or any other third party.
• BookingCo's total liability to you (and to all guests in your booking) arising from your use of SafariBookNow, regardless of cause, is limited to the lesser of (a) the technology service fee BookingCo earned for facilitating that booking and (b) ZAR 1,000.
• BookingCo is not liable for any indirect, consequential, special, punitive, or incidental damages.

Nothing in these Terms excludes liability that cannot lawfully be excluded under South African law, including under the Consumer Protection Act 68 of 2008.

8. Liability — ASG and the Suppliers

ASG's liability for the booking is governed by ASG's Terms (see in particular clauses 7 Force Majeure, 11.10, 13 Disclaimer, and 14 Applicable Law). To the extent permitted by law, ASG shall not be liable for the acts or omissions of any Supplier or third party, or any failure, defect or shortcoming in Supplier services, save to the extent caused by ASG's own gross negligence or wilful misconduct. The lodge ("Supplier") is liable for its own services in accordance with its own terms.

9. Indemnity

You agree to indemnify and hold harmless BookingCo and ASG (and each of their directors, employees, agents, and contractors) from any claim, loss, damage, liability or expense (including legal fees on the highest scale) arising from:

• Your misuse of SafariBookNow;
• Your breach of these Terms or of ASG's Terms;
• Your or any guest's participation in any activity forming part of the booking;
• Any failure by you or a guest to follow safety instructions or comply with local laws or Supplier requirements;
• Any claim brought by a guest in your party against BookingCo or ASG, except to the extent caused by BookingCo's or ASG's gross negligence or wilful misconduct.

10. Personal information and POPIA

BookingCo's processing of personal information collected via the SafariBookNow website is described in our Privacy Policy. Where personal information is transmitted from SafariBookNow to ASG to facilitate your booking, ASG is the operator and controller of that information in accordance with ASG's data-protection terms (see ASG's Terms, clause 11) and POPIA. Queries about ASG's data handling should be directed to ASG at hi@africansafarigroup.com.

11. Acceptable use of SafariBookNow

You agree not to: make fraudulent or unauthorised bookings; use SafariBookNow to send unsolicited messages, scrape content, or interfere with the site's operation; reproduce, distribute, or republish any lodge content or imagery outside personal use without written permission; or attempt to gain unauthorised access to any part of the site or any backing system (including Reservaroo).

12. Content and intellectual property

SafariBookNow site content (other than lodge content sourced from ASG and the Suppliers) is owned by BookingCo or its licensors and is protected by copyright and trademark law. Lodge content (photographs, descriptions, pricing) is sourced from ASG and the Suppliers and is used with their permission.

13. Chargebacks

You agree not to initiate a chargeback with your bank or card issuer for any amount charged in respect of a booking without first contacting ASG in writing and giving ASG a reasonable opportunity to resolve the dispute. Chargebacks initiated in breach of this clause may be disputed by ASG and recovered through collection or legal action under ASG's Terms, clause 6.7.

14. Changes to the service or these Terms

BookingCo may change, suspend or discontinue any part of SafariBookNow at any time. We may update these Terms; the "Last updated" date at the top of this page always reflects the current version, and continued use of the site after a change constitutes acceptance. ASG may update its own Terms separately — see ASG's Terms, clause 15.

15. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any dispute that cannot be resolved through discussion will be referred to the High Court, Western Cape Division, Cape Town, in line with ASG's own choice of forum.
